This Privacy Policy (the “Policy”) describes how mixi, Inc. and its affiliates (“MIXI”, "we", "our" or "us") collect and use personal information that you provide when you access, download and/or use Asym (“App”). This Policy also applies to any other services that we may provide in relation to the App, such as customer support, social media, community channels and other websites that we may operate from time to time.

By “personal information,” MIXI means personal information that directly identifies you. In this Policy, “you” means any person who uses our App.

    • Functional cookies, which allow us to customize our App content and communicate with other users.
    • Cookies designed for measuring traffic, which do not collect personal data. Traffic monitoring tools are used to gather information  about how visitors use the App.

While MIXI will continue to exercise diligence and use measures to protect the security of this App, MIXI cannot warrant that all internet communications will be secure. Although we have procedures and security measures in place to protect your personal information, we cannot guarantee the security of your information transmitted to our App; and any transmission is at your own risk. 4. RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION

You have a right to request the deletion of the email address that we collect from you. To submit a request to delete your email address, please submit an email request to asym_contact@ml.mixigroup.jp and include “California Request to Delete” in the subject line or fill out [Portal Request]. Please specify in your request that you would like to have your email address deleted, as required by the CCPA.

MIXI is required to verify your identity. The information that MIXI asks you to provide to verify your identity will depend on your prior interactions with us and the sensitivity of the personal information at issue. Once confirmed, MIXI will respond to your request in accordance with the CCPA. MIXI will provide an explanation for denying a request.

5. “SALE” OF PERSONAL INFORMATION.

Under the CCPA, “sale” is broadly defined to mean the sharing of personal information with third parties who are not acting as our service providers or who are otherwise not restricted from using data only on our behalf or pursuant to an applicable CCPA exception.

Please note that we do not knowingly sell your personal information or the personal information of minors under 16 years of age without legally-required affirmative authorization.

6. RIGHT TO NON-DISCRIMINATION FOR THE EXERCISE OF CCPA RIGHTS

You may not be discriminated against because you exercise any of your rights under the CCPA in violation of California Civil Code § 1798.125.

7. AUTHORIZED AGENT

You can designate an authorized agent to make a request under the CCPA on your behalf if:

  • The authorized agent is a natural person, or a business entity registered with the Secretary of State of California and the agent provides proof that you gave the agent signed permission to submit the request; and
  • You directly confirm with MIXI that you provided the authorized agent with permission to submit the request.

If you use an authorized agent to submit a request to exercise your right to know or your right to request deletion, please ensure authorized agent sends an email to asym_contact@ml.mixigroup.jp with subject “California Request to Delete” with the attachment of both the user in question and the Authorized agent’s ID with a notarized letter verifying the relationship (e.g. parent or guardian) with detailed information on the requested data to be deleted.

If you provide an authorized agent with power of attorney pursuant to Probate Code sections 4121 to 4130, it may not be necessary to perform these steps and we will respond to any request from such authorized agent in accordance with the CCPA.

MIXI will take steps that are reasonably necessary to ensure that your personal data is treated in accordance with applicable data protection laws, including, where relevant, entering into standard contractual clauses (or equivalent measures) with the party receiving the personal data. You have a number of rights in relation to your personal data, which are summarised below:

  • Access: You have the right to confirm with MIXI whether your personal data is processed, and if it is, to request access to that personal data including the categories of personal data processed, the purpose of the processing and the recipients or categories of recipients. MIXI does have to take into account the interests of others though, and if you want to request more than one copy we may charge a fee.
  • Rectification: You may have the right to rectify inaccurate or incomplete personal data concerning you. In particular, you have the right to have incomplete personal data completed.
  • Erasure: You may have the right to ask MIXI to erase personal data concerning you.
  • Restriction of processing: In limited circumstances, you may have the right to request that MIXI restrict processing of your personal data.
  • Data portability: You may have the right to receive personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you may have the right to transmit that data to another entity.
  • Objection and rights relating to automated decision-making: Under certain circumstances you may have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data, including profiling, by MIXI, and MIXI can be required to no longer process your personal data. This may include requesting human intervention in relation to an automated decision so that you can express your view and to contest the decision.
  • Direct marketing: You have the right to withdraw your consent for receiving direct marketing from MIXI at any time. You can do this for example by clicking on the "unsubscribe" link in an email that MIXI has sent to you, or by contacting us at the details in Section 4 below.
